How many times have you heard it? Litigation costs are on the rise. “Big Data” is everyone’s nightmare. There is no room for inefficient and expensive ediscovery. Predictive coding will save the day.

Time for some straight talk. One of the bigger hurdles facing corporations looking to fix their ediscovery woes: tunnel-vision. Most organizations’ ediscovery responses revolve around a reactive process related to a single matter. There is no continuity from one project to the next, and for most organizations, the ediscovery process begins anew with each project. Collect, review, produce. Repeat. Collect, review, produce. Repeat. In reality, the same custodians’ documents and email are frequently needed across projects, and an organization’s inability to leverage past document collections and valuable document review work product from one project to the next is archaic.

It seems simple, right? Why can’t corporations easily find the formula for multi-matter management across their portfolio of ediscovery projects? They need an ediscovery “lifestyle change” – reduce, reuse, recycle. The goal: move away from the disjointed, individual project approach and replace it with standardized business processes and portfolio management technology.

Predictive Coding is the hottest ediscovery technology today to save money and time. However, even the best Technology Assisted Review (TAR) protocol on the right-side of the Electronic Discovery Reference Model (EDRM) will falter if the left-side of the EDRM is ignored. From information management to preservation and collection, the early stages of the EDRM are the easiest place for mistakes to spawn an investigation, regulatory request, or litigation. For example, if your organization over-preserves, costs skyrocket for data you don’t need. If you under-collect, your organization could face penalties for missing critical documents. If you have no plans and limited technology resources, billable hours will escalate beyond imagination simply to gather and identify targeted data.

What Honeybaked Ham Can Teach Us About BYOD, BYOC, and the Future of Ediscovery

In late 2012, a court in Colorado in E.E.O.C. v. Original Honeybaked Ham Co. of Georgia ordered production of data contained on social media sites under the control of plaintiff class members in a sexual harassment suit. To balance privacy factors, the judge established a process leveraging a special master to assist in collection and in camera review of the Facebook, blog post, and cell phone data. While today the discovery of data contained on Facebook or smart phones seems complex, there are bigger problems on the horizon. For example, analyst firm Gartner predicts that by 2017, half of all employers will require employees to provide their own technology devices for work. Bring your own device (BYOD) or bring your own cloud (BYOC) policies are just two examples of future issues that will push ediscovery boundaries in coming years.

New Minnesota Rules of Civil Procedure Are Coming – Are You Ready?
